Introduction
Welcome to Nexasec. These Terms and Conditions (“Terms”) govern the relationship between Nexasec Pty Ltd (“Nexasec”, “we”, “our”, or “us”) and any individual, business, or organisation (“Client”, “you”, or “your”) engaging our electronic security, network infrastructure, or smart automation services.
Nexasec is headquartered in Dandenong North, Victoria, and services residential and commercial properties across all of Victoria. All our technicians hold current Victorian security licences and Nexasec is fully insured.
Our motto — Security. Networks. Automation. — reflects our commitment to delivering integrated, technically superior solutions built for Australian homes and businesses. These Terms exist to protect both parties and ensure every engagement is clear, transparent, and fair.
Acceptance of Terms
By requesting a quote, signing a Nexasec proposal or service agreement, authorising work to commence, making any payment, or permitting Nexasec technicians access to your property, you confirm that you have read, understood, and agree to be bound by these Terms.
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not have that authority, or if you do not agree with any part of these Terms, you must not engage our services.
These Terms apply to all services provided by Nexasec including but not limited to on-site assessments, installation projects, maintenance visits, emergency call-outs, and ongoing support.
Services Provided
Nexasec provides the following categories of service across Victoria:
CCTV Surveillance
Supply and installation of wired IP camera systems including PoE infrastructure, NVR recording, remote app access, and onsite training.
Alarm Systems
Supply and installation of multi-zone intrusion detection systems with smart app monitoring, backup power, and sensor placement.
Access Control
Supply and installation of electronic access control including card readers, biometric devices, intercoms, electric strikes, and magnetic locks.
Video Intercoms
Supply and installation of video intercom systems for residential and commercial entry points with mobile app integration.
Security Networks
Design and installation of structured cabling, enterprise Wi-Fi, and network infrastructure to support security and automation systems.
Smart Automation
Integration of security, access, lighting, and building management into unified smart home and commercial automation platforms.
All services also include ancillary activities such as free onsite assessments, written quotations, equipment procurement, cable management and patching, wall and ceiling penetrations, commissioning and testing, and user handover training.
Services are subject to the specific scope outlined in the applicable written quote or proposal. Any work beyond that scope requires a written variation approved by both parties prior to commencement.
Quotes & Pricing
Nexasec provides free, no-obligation written quotes for all residential and commercial projects following an onsite assessment. Written quotes are valid for thirty (30) days from the date of issue unless otherwise stated.
All prices are in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST) unless expressly stated otherwise. GST will be added to invoices at the applicable rate in accordance with Australian tax law.
Transparent Pricing — No Surprises
Nexasec operates on a fixed-price model wherever possible. Our written quote is the price you pay. If site conditions require a variation, we will notify you in writing before performing any additional work. We do not proceed with out-of-scope work without your written approval.
Quoted prices cover the supply of all specified equipment, installation labour, cabling, wall and ceiling penetrations reasonable to standard residential or commercial construction, commissioning, testing, and one session of onsite user training.
Prices do not include: specialist trades required by local authority or building regulations (e.g. licensed electricians beyond standard low-voltage work), permits or council approvals, work in confined spaces requiring specialist equipment, patching or repairing surfaces after installation, or costs arising from pre-existing faults in the Client’s infrastructure.
Our standard CCTV packages (from $1,890 for 2-camera through to $3,415 for 6-camera) are fixed-price supply-and-install packages. Custom commercial or multi-site projects are priced individually following a detailed assessment.
Payment Terms
Payment terms are as follows unless otherwise agreed in writing:
- —Residential projects: Full payment is due on the day of installation completion, prior to the technician leaving site.
- —Commercial projects: A deposit of up to 50% of the quoted price may be required prior to equipment procurement. The balance is due on practical completion.
- —Ongoing maintenance agreements: Invoiced monthly or quarterly in advance as specified in the maintenance contract.
- —Emergency call-outs: Invoiced on completion of works and due within fourteen (14) days.
Nexasec accepts payment by EFT (bank transfer), credit card (Visa and Mastercard), and cash. Credit card payments may incur a surcharge to cover merchant fees — this will be disclosed prior to payment. Cheques are not accepted.
Where payment is not received within the agreed terms, Nexasec reserves the right to charge interest on overdue amounts at the rate of 10% per annum calculated daily, suspend ongoing services, and pursue recovery of outstanding amounts including reasonable debt collection costs.
Title to all equipment supplied by Nexasec does not pass to the Client until full payment is received. Nexasec retains a purchase money security interest (PMSI) in all supplied goods under the Personal Property Securities Act 2009 (Cth) until payment is made in full.
Scheduling & Installation
Nexasec will schedule installation at a mutually agreed time. The Client is responsible for ensuring:
- ✓Safe and unobstructed access to all areas where work is to be performed, including roof spaces, wall cavities, and plant rooms.
- ✓A responsible adult is present on-site for the full duration of the installation.
- ✓All relevant property information is disclosed prior to commencement, including the location of in-wall services (electrical, plumbing, gas), heritage restrictions, and strata by-laws where applicable.
- ✓Adequate power is available at or near the installation location.
- ✓Any required approvals from body corporate, landlords, or strata managers have been obtained prior to the booking date.
If installation cannot proceed or is significantly delayed due to the Client’s failure to meet the above obligations, a call-out fee may be charged to cover labour and travel costs. Nexasec will notify the Client as soon as practicable if rescheduling is required from our end due to illness, emergencies, or events outside our control.
Timeframes provided in quotes are estimates only. Nexasec is not liable for delays caused by factors outside our reasonable control including but not limited to weather, supplier lead times, or difficult site conditions discovered after commencement.
Workmanship Guarantee
30-Day Workmanship Guarantee
All Nexasec installations are backed by a 30-day workmanship guarantee. If something we installed fails due to a defect in materials or our installation work within 30 days of the installation date, we will return to rectify it at no additional charge.
The 30-day workmanship guarantee covers our installation work only — faults arising from our installation methods, cable runs, terminations, and system configuration completed by Nexasec. It does not extend to the supplied hardware itself; equipment defects are covered by the relevant manufacturer warranty, which Nexasec will pass through to the Client.
The guarantee does not cover: damage caused by misuse, tampering, power surges, or acts of third parties; equipment or cabling modified by the Client or another contractor after handover; consumable items such as batteries; issues arising from the Client’s pre-existing infrastructure or connectivity (internet, power supply); or systems that have not been maintained in accordance with manufacturer recommendations.
Equipment manufacturer warranties are passed through to the Client where applicable. Nexasec will assist Clients in lodging warranty claims with manufacturers but does not itself warrant manufacturer equipment beyond the 30-day installation period unless a separate extended warranty is purchased.
To make a guarantee claim, contact Nexasec on 0494 580 608 or info@nexasec.com.au. Nexasec will respond within 2 business days and schedule a rectification visit as soon as practicable. Clients must allow Nexasec a reasonable opportunity to rectify defects before engaging a third party.
Equipment & Ownership
Upon receipt of full payment, title in all supplied equipment passes to the Client. The Client then becomes the owner and is responsible for the ongoing care, maintenance, and insurance of that equipment.
Nexasec recommends that Clients notify their home or contents insurer of newly installed security systems. The presence of a monitored or certified alarm system may reduce insurance premiums — Clients should confirm this independently with their insurer.
Any system designs, drawings, schematics, software configurations, and programming created by Nexasec remain the intellectual property of Nexasec. Clients are granted a non-exclusive licence to use such documentation solely for the operation and maintenance of their installed system. Reproduction, resale, or distribution of Nexasec documentation without written consent is prohibited.
Where Nexasec installs third-party software platforms (e.g. camera apps, access control software, automation controllers), the Client’s use of those platforms is governed by the respective manufacturer’s terms and licence agreements. Nexasec is not party to, and does not accept responsibility for, those third-party terms.
Monitoring Services
Unless expressly included in the written quote and agreed by both parties in writing, Nexasec’s services do not include professional 24/7 alarm monitoring by an external monitoring centre.
Where Nexasec installs systems capable of self-monitoring via mobile app (such as Ajax Systems), the Client is responsible for managing their own notifications and responses. Nexasec provides configuration and training for these features but does not itself act as a monitoring centre.
Where a Client wishes to connect an alarm system to a professional monitoring centre, Nexasec can assist with installation of monitoring-compatible hardware and programming. The monitoring agreement itself is between the Client and the chosen monitoring provider and is subject to that provider’s terms. Nexasec is not liable for the performance of any third-party monitoring service.
Limitation of Liability
To the fullest extent permitted by law, Nexasec’s total liability to the Client for any claim arising out of or in connection with these Terms or the services provided — whether in contract, tort (including negligence), or otherwise — is limited to the amount paid by the Client for the specific service giving rise to the claim.
Nexasec is not liable for: indirect, consequential, special, or punitive loss or damage; loss of profits, revenue, data, or business opportunity; loss arising from theft, burglary, vandalism, or any criminal act even where a security system was installed; loss arising from system failure, power outage, internet outage, or third-party service interruptions; or loss arising from the Client’s failure to maintain, use, or operate the system correctly.
Security systems reduce risk — they do not eliminate it. Nexasec does not warrant that any system will prevent crime or detect every intrusion event, and the Client accepts this inherent limitation when engaging our services.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied by applicable Australian consumer law (including the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth)), to the extent that such exclusion, restriction, or modification would make these Terms void or unenforceable.
Privacy & Data
Nexasec is committed to protecting Client privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. We collect personal information including name, contact details, property address, and payment information solely for the purpose of delivering and supporting our services.
Client information is not sold or shared with third parties for marketing purposes. We may share information with trusted service providers (e.g. equipment suppliers, accounting software) strictly as necessary to deliver our services. All such providers are bound by appropriate confidentiality obligations.
For full details of how Nexasec collects, uses, stores, and protects personal information, please refer to our Privacy Policy.
Where Nexasec installs CCTV systems, the Client is responsible for operating those systems in compliance with applicable privacy legislation, including providing appropriate signage and ensuring cameras are positioned to capture only areas the Client is lawfully entitled to surveil. Nexasec provides guidance on best practice but is not liable for any privacy breach arising from the Client’s operation of installed systems.
Cancellation
The Client may cancel a confirmed booking without penalty by providing at least 48 hours’ written notice prior to the scheduled installation date.
Cancellations made with less than 48 hours’ notice, or where the technician attends site and cannot proceed due to circumstances within the Client’s control, may attract a cancellation or call-out fee. This fee will not exceed a reasonable proportion of the quoted project value and will be communicated to the Client before being charged.
Where equipment has been procured specifically for the Client’s project prior to cancellation, the Client may be liable for the cost of that equipment less any reasonable resale value. Nexasec will make every effort to minimise such costs.
Nexasec may cancel or reschedule a booking in circumstances beyond our control, including illness, equipment delays, or extreme weather. In such cases, no cancellation fee applies and Nexasec will reschedule at the earliest mutually convenient time.
Dispute Resolution
We value our relationships with every Client. If you have a concern about our work or this agreement, please contact us first — we will always try to resolve issues directly, promptly, and fairly.
In the event of a dispute, the parties agree to the following process:
- 1
The Client notifies Nexasec of the dispute in writing (email to info@nexasec.com.au) with a clear description of the issue and the outcome sought.
- 2
Nexasec will acknowledge receipt within 2 business days and respond substantively within 10 business days.
- 3
If the dispute is not resolved within 30 days of the initial written notice, either party may refer the matter to mediation through a mutually agreed mediator or the Resolution Institute.
- 4
If mediation is unsuccessful, either party may pursue the matter through the courts of Victoria.
Nothing in this clause prevents either party from seeking urgent injunctive or other interlocutory relief from a court where necessary.
Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria and any courts competent to hear appeals from those courts.
Where any provision of these Terms is found to be invalid, unenforceable, or illegal under applicable law, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.
Amendments
Nexasec reserves the right to update or modify these Terms at any time. When we do so, we will update the “Last Updated” date at the top of this page. The current version of these Terms always applies to any new engagement.
For ongoing service agreements in place at the time of an amendment, the previous Terms continue to apply unless the Client is notified in writing and agrees to the updated Terms. Continued use of our services following notification of a change constitutes acceptance of the updated Terms.
